Fideicomiso is the Spanish word for a specific type of trust, which is established by a Mexican bank and allows foreigners to purchase property within the restricted zone, which includes any land within 50 kilometers (31 miles) of the coast and 100 kilometers (62 miles) away from any Mexican border.

Fideicomisos as well as Mexican corporations are the legal figures that allow foreigners to purchase property in México, and to do so while still meeting the requirements of the Mexican Constitution, the trust has a 50-year term, renewable for another 50 years.

This gives foreigners the exact same rights as Mexicans when it comes to property ownership. You can either buy, rent, sell, or modify the property.

QUICK CLOSING PROCESS OVERVIEW

The closing process is a very intricate set of steps that are performed, and one step cannot be performed before the other has been completed.

This process has a standard time frame for a cash purchase transaction where both the Buyer´s and Seller´s documents are all in order at the beginning of the closing timeline.


There are so many variables that can occur because we are dealing with Buyer´s and Seller´s who are typically not in Mexico and we have many third parties who are involved in the process such as public notaries, homeowners associations, Buyer and Seller closing Agents, Foreign Affairs Minister for the fideicomiso permit, trust banks, government offices, etc.

The time frame that you or the seller agree on is recommended as an estimated date, however, the real closing date will be determined by the Public Notary once all of the closing documentation has been completed, and, from there, final signatures will be scheduled.

Typically, the final date can be determined within the las two weeks of closing. 

Given all the variables that exist in a Closing, defining whether the buyers and sellers will be present in México for the closing date is essential, otherwise, a POA (power of attorney) will be needed.

In this case, you will close with a Limited Power Of Attorney for the purpose of signing the deed transfer only or a General Power of Attorney with its powers limited to signing documents only for the sale of a particular purchaser. All other documents will be executed by all parties during the closing process.
